Acceptance of Terms
The Mobile Locker Co., Inc. (“TMLC,” “We,” “Us,” or “Our”) provides temporary, short-term locker rental and storage services to event attendees and guests (the “Service” or “Services”). By renting or using any locker, storage unit, or any other Service from TMLC, you (“Customer,” “You,” or “Your”) agree to these Terms of Use (“Terms”). Your use of any Service, whether reserved in advance or rented on-site and whether paid directly by You or by another party, constitutes Your acknowledgment that You have read, understood, and agreed to these Terms, including any event-specific conditions posted at the rental location or on TMLC’s website. If You do not agree to these Terms, You may not rent, access, or use any locker or related Service provided by TMLC.
Locker Use
You may use the TMLC Service solely for the temporary storage of personal items and other belongings during the event period for which it is rented, reserved, or made available to You. “Use” includes any action to access, store, or retrieve items from a locker or storage unit, whether such locker or storage unit was paid for by You directly or provided to You as a complimentary amenity through an event organizer, venue, sponsor, or other third party (each, a “Sponsoring Entity”). Regardless of payment source, Your use of the Service constitutes Your agreement to be bound by these Terms. If a Sponsoring Entity provides the Service to You free of charge or as part of Your event admission, You acknowledge that TMLC remains the service provider and that these Terms govern Your use of the Service.
The Services are intended only for lawful, non-commercial, personal use. You may not share, sublicense, or otherwise transfer Your locker or storage unit access to others without TMLC’s consent. You are responsible for ensuring Your locker is properly secured during use. Unless otherwise approved by TMLC, You are prohibited from storing the following:
- Illegal substances or paraphernalia
- Weapons, ammunition, explosives, or fireworks
- Flammable, toxic, or hazardous materials
- Perishable goods or live animals
- Valuables of unusually high value (including cash, jewelry, electronics, or identification documents)
- Any item prohibited by venue, event, or security policy, or by applicable law
TMLC reserves the right, in coordination with event security or law enforcement, to open, inspect, or remove any item if We reasonably believe the locker or storage unit contains prohibited, unsafe, or unlawful materials.
Rental Period
Locker rental is valid only for the duration of the event or rental period stated at the time of purchase. Items not retrieved by the end of the rental period will be handled per Section 6 (“Unclaimed Property”).
Fees and Payments
All rental fees, if required, are due at the time of booking. Rental fees are non-refundable, except (a) in cases of event cancellation by the organizer, or (b) where TMLC is unable to provide the Service due to a Force Majeure Event as described in Section 8, in which case TMLC will, at its discretion, either refund the rental fee or issue a credit toward a future rental. TMLC is not responsible for any other costs, expenses, or losses You may incur in connection with an event cancellation or Force Majeure Event.
Limitation of Liability
TMLC provides lockers and temporary storage for convenience only and does not assume responsibility for loss, theft, or damage to stored items. You store items at your own risk. To the maximum extent permitted by law, TMLC’s total liability arising out of or related to Your use of the Service shall not exceed the greater of (a) the amount You paid for the applicable rental, or (b) $25, regardless of whether the Service was provided directly by TMLC, complimentary through a Sponsoring Entity, or otherwise at no charge to You. TMLC shall not be liable for indirect, incidental, special, or consequential damages of any kind. Nothing in this Section limits TMLC’s liability for gross negligence or willful misconduct to the extent such limitation is not permitted by applicable law.
Indemnification
You agree to indemnify, defend, and hold harmless TMLC, its officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) Your breach of these Terms; (b) Your violation of any law or third-party right; (c) Your storage of any prohibited, illegal, hazardous, or unauthorized item; or (d) any injury, loss, or damage caused by an item You stored.
Unclaimed Property
Any items left in TMLC’s possession after the rental period ends will be considered unclaimed. TMLC may remove and securely store items for up to 14 days from the end of the rental period (the “Claim Period”). During the Claim Period, Customers may arrange for the retrieval and return of their unclaimed items, subject to the following terms and conditions. Customers must email TMLC at hello@themobilelockerco.com or use the Contact Us form located at https://www.themobilelockerco.com/contact-us/, and submit their request before the Claim Period ends. Customer will be required to complete an Unclaimed Item Claim Form, which may include, proof of locker rental (such as receipt, confirmation email, or payment record), a description of the item sufficient to identify it, proof of identity, and direction for returning the unclaimed item.
Customers are responsible for all shipping costs associated with the return of unclaimed items, and TMLC will charge a handling fee to cover retrieval, packaging, and administrative time. Upon receipt of a Customer submission regarding unclaimed items, TMLC will provide a shipping cost estimate and a secure payment link for customer to remit to TMLC all shipping and handling costs. Shipment will occur only after payment in full is received. All shipments will be made using a trackable carrier selected by TMLC, and risk of loss transfers to the customer once the package is tendered to the carrier. TMLC does not guarantee the recovery of unclaimed items and shall not be liable for any loss, delay, or damage occurring in connection with the retrieval, handling, or shipment of unclaimed property. Retrieval of unclaimed property is offered solely as a customer courtesy.After the Claim Period, unclaimed items will be considered abandoned and may be disposed of, donated, or destroyed at TMLC’s sole discretion without further notice or obligation. Customer Conduct
You agree to use the locker responsibly and comply with all venue rules and security procedures. TMLC reserves the right to deny service or terminate access to anyone acting in an unsafe, disruptive, or unlawful manner.
Force Majeure
TMLC is not responsible for failure to provide locker access due to events beyond its reasonable control, including weather, acts of God, strikes, power failures, or venue closures (each, a “Force Majeure Event”).
Dispute Resolution; Arbitration Agreement
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
Any dispute, claim, or controversy arising out of or relating to these Terms or Your use of the Service (a “Dispute”) shall be resolved by binding arbitration on an individual basis, except that either party may bring an individual claim in small claims court. The arbitration shall be administered by American Arbitration Association under its consumer arbitration rules then in effect.YOU AND TMLC EACH AGREE THAT ANY DISPUTE WILL BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate the claims of more than one party. These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles, to the extent not preempted by the Federal Arbitration Act.
Eligibility
You represent that You are at least 18 years of age, or the age of legal majority in Your jurisdiction, and have the legal capacity to enter into these Terms. If You are under 18, You may use the Service only under the supervision of, and with the consent of, a parent or legal guardian who agrees to be bound by these Terms on Your behalf. TMLC reserves the right to request proof of age or guardian consent and to refuse or terminate Service if such proof is not provided.
Entire Agreement
These Terms, together with any event-specific conditions displayed at the point of sale, constitute the entire agreement between you and TMLC regarding your storage rental and use, and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall continue in full force and effect.
Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. TMLC may assign these Terms at any time to an affiliate or successor without notice.
Amendments
TMLC may update these Terms at any time by posting a revised version on its website or by providing a revised version to Customer at point of sale. Any such updated version will apply to all future locker rentals.
